Legal Terms and Disclaimer

1. Platform Disclaimer

RGS Foundation provides an online platform that facilitates fundraising and donations for individuals, families, communities, and charitable causes in need.

While we may review campaigns and request supporting information, RGS Foundation does not guarantee:

  • The complete accuracy of information provided by campaign organizers
  • That donated funds will be used exactly as described in every circumstance
  • That a campaign will achieve its fundraising target
  • That any medical, financial, personal, or charitable objective will produce a particular outcome
  • The continued availability of any campaign or service

Users are responsible for evaluating campaigns before making a donation. Use of the platform is subject to these terms and undertaken at the user’s own discretion.

2. No Legal, Financial, Tax, or Medical Advice

Information published on the RGS Foundation platform is provided for general informational and fundraising purposes only.

Nothing on the platform should be interpreted as:

  • Legal advice
  • Financial or investment advice
  • Tax advice
  • Medical advice, diagnosis, or treatment
  • A professional recommendation or guarantee

Users should consult qualified legal, financial, tax, or medical professionals before making decisions based on information presented through a campaign or elsewhere on the platform.

3. Campaign Organizer Responsibilities

Campaign organizers are solely responsible for:

  • Providing accurate, complete, and truthful information
  • Having the authority or consent required to create a campaign
  • Using donated funds for the purposes represented to donors
  • Complying with applicable local, national, and international laws
  • Obtaining any necessary licenses, permissions, or approvals
  • Paying applicable taxes, fees, or reporting obligations
  • Protecting the privacy and dignity of beneficiaries
  • Keeping donors informed of significant changes affecting the campaign

RGS Foundation does not assume responsibility for the legal, regulatory, financial, or tax obligations of individual campaign organizers or beneficiaries.

4. Campaign Review and Verification

RGS Foundation may review campaigns, request identification or supporting documentation, and conduct additional checks when considered necessary.

A campaign’s publication on the platform does not constitute an endorsement, certification, or guarantee by RGS Foundation.

We reserve the right to suspend, restrict, investigate, or remove campaigns that:

  • Contain false, misleading, or incomplete information
  • Violate applicable laws or platform policies
  • Present suspected fraud, misuse, or security risks
  • Infringe the rights of another person or organization
  • Create an unacceptable risk to donors, beneficiaries, or the platform

5. Fraud Prevention and User Safety

We take reasonable measures to protect donors, organizers, beneficiaries, and the integrity of the platform.

These measures may include:

  • Monitoring campaigns and transactions for suspicious activity
  • Requesting identity or beneficiary verification
  • Reviewing supporting documents
  • Investigating complaints and reports of misuse
  • Restricting access to funds while a review is conducted
  • Cooperating with payment providers and legal authorities when appropriate

However, no verification or security process can eliminate every risk. Users should donate responsibly, review available campaign information, and report suspicious activity to RGS Foundation.

6. Donations, Payments, and Refunds

Donations may be processed by independent third-party payment providers. Their terms, privacy policies, processing rules, and refund procedures may also apply.

Processing fees, currency-conversion charges, taxes, or other transaction costs may be deducted or charged where applicable.

Unless required by law or expressly permitted under our refund policy, donations may be final and non-refundable after processing. Requests involving suspected fraud, duplicate payments, unauthorized transactions, or campaign cancellation will be reviewed individually.

RGS Foundation does not guarantee that every refund request will be approved.

7. Intellectual Property

Unless otherwise stated, the RGS Foundation name, branding, logos, website design, text, graphics, software, and original platform materials are owned by or licensed to RGS Foundation.

Users may not copy, reproduce, modify, distribute, publish, sell, license, or commercially exploit these materials without prior written authorization.

Campaign organizers retain responsibility for the content they submit. By publishing content on the platform, they grant RGS Foundation the permission necessary to host, display, reproduce, adapt, and promote that content for campaign administration, fundraising, verification, and communication purposes.

Campaign organizers must not submit content that infringes intellectual property, privacy, publicity, or other legal rights.

8. Third-Party Services and Links

RGS Foundation may use or provide access to third-party services, including:

  • Payment processors
  • Website hosting and infrastructure providers
  • Identity-verification services
  • Analytics and security providers
  • Email and communication platforms
  • Advertising and social media platforms

These third parties operate independently and may have their own terms and privacy policies.

To the fullest extent permitted by law, RGS Foundation is not responsible for the availability, security, actions, policies, errors, or failures of third-party services.

9. Platform Availability

We aim to keep the platform available and operating properly, but we do not guarantee uninterrupted, error-free, or secure access.

The platform may be temporarily unavailable because of:

  • Maintenance or updates
  • Technical failures
  • Cybersecurity incidents
  • Third-party service interruptions
  • Events outside our reasonable control

RGS Foundation may modify, suspend, or discontinue any feature or service when reasonably necessary.

10. Limitation of Liability

To the fullest extent permitted by applicable law, RGS Foundation and its directors, officers, employees, volunteers, contractors, and partners will not be liable for:

  • Losses resulting from a donation or fundraising campaign
  • Misuse, misrepresentation, or mismanagement of funds by organizers or beneficiaries
  • Decisions made based on campaign information
  • Failure of a campaign to meet its objective
  • Acts or omissions of third-party providers
  • Unauthorized access, fraud, or security incidents beyond our reasonable control
  • Platform interruptions, data loss, or technical errors
  • Indirect, incidental, special, punitive, or consequential damages

Nothing in these terms excludes or limits liability that cannot legally be excluded under applicable law.

11. Indemnification

To the extent permitted by law, users agree to defend, indemnify, and hold harmless RGS Foundation and its directors, officers, employees, volunteers, contractors, and partners from claims, losses, liabilities, damages, costs, and expenses arising from:

  • Their use or misuse of the platform
  • Their fundraising activities
  • Content or information they submit
  • Misuse of donated funds
  • Violation of these terms
  • Violation of applicable law
  • Infringement of another person’s rights

12. Copyright and Rights Complaints

Anyone who believes that content published on the platform violates their copyright, privacy, intellectual property, or other legal rights may submit a removal request.

The request should include:

  • A clear description of the disputed content
  • The location of the content on the platform
  • Evidence of ownership, authorization, or the relevant legal right
  • The requester’s full name and contact information
  • A statement explaining why the content should be removed
  • Any supporting documents reasonably required for review

RGS Foundation may request additional information before taking action.

13. Suspension and Termination

RGS Foundation may suspend or terminate a user’s access to the platform when we reasonably believe that the user:

  • Violated these terms or another platform policy
  • Submitted false or misleading information
  • Engaged in fraud, abuse, or unlawful conduct
  • Created a risk to donors, beneficiaries, or the platform
  • Interfered with the operation or security of the website

Where appropriate, funds may be temporarily restricted while an investigation is conducted.

14. Governing Law and Jurisdiction

These terms will be governed by the laws of the jurisdiction in which RGS Foundation is legally established, without regard to conflict-of-law principles.

Any dispute will be handled by the courts or dispute-resolution bodies with legal authority in that jurisdiction, unless applicable consumer law requires otherwise.

The organization’s registered jurisdiction and address should be inserted into the final published version of these terms.

15. Changes to These Terms

RGS Foundation may update these Legal Terms periodically to reflect changes in our services, policies, technology, or legal obligations.

The revised version will be published on this page with an updated effective date. Continued use of the platform after the revised terms become effective constitutes acceptance of those changes, to the extent permitted by law.
