1. Acceptance of Terms

By accessing or using the RGS Foundation website, platform, or services, you agree to be bound by these Terms of Service, as well as our Privacy Policy, Cookie Policy, and any other policies published on our website.

If you do not agree with these terms, you must not access or use our services.

2. About RGS Foundation

RGS Foundation is a nonprofit organization dedicated to supporting individuals, families, and communities facing illness, poverty, hunger, homelessness, emergencies, and other difficult circumstances.

Our platform connects people and causes in need with donors who wish to provide financial and humanitarian support through fundraising campaigns.

3. User Roles

Users of the RGS Foundation platform may participate as:

  • Donors: Individuals or organizations that make financial contributions to campaigns.
  • Organizers: Individuals or authorized entities that create and manage fundraising campaigns.
  • Beneficiaries: Individuals, families, communities, or causes intended to receive support from a campaign.
  • Visitors: Individuals who browse or interact with the platform without making a donation or creating a campaign.

A person may act in more than one role, subject to these Terms of Service.

4. Eligibility

By using the platform, you confirm that:

  • You have the legal capacity to accept these terms.
  • The information you provide is accurate, complete, and current.
  • You will use the platform only for lawful purposes.
  • You are not prohibited from using our services under applicable law.

Users under the legal age required in their jurisdiction may only use the platform with the authorization and supervision of a parent, legal guardian, or authorized representative.

5. Donations

All donations are voluntary.

By making a donation, the donor acknowledges that:

  • The donation is made voluntarily and without expectation of financial return.
  • Campaign outcomes and fundraising targets cannot be guaranteed.
  • Information submitted by campaign organizers may be subject to review but cannot be guaranteed to be completely accurate in every circumstance.
  • Donations are generally final and non-refundable, except when required by law or approved under our refund procedures.
  • Payment processing, currency-conversion, banking, or platform fees may apply.

Donors are responsible for reviewing the available campaign information before making a contribution.

6. Refunds and Payment Disputes

Refund requests may be considered in circumstances involving:

  • Duplicate transactions.
  • Unauthorized payments.
  • Confirmed fraud or material misrepresentation.
  • Technical payment errors.
  • Campaign cancellation before funds are distributed.
  • Situations in which a refund is required by applicable law.

Submitting a request does not guarantee that a refund will be approved.

Users should contact RGS Foundation before initiating a payment dispute or chargeback so that we have an opportunity to investigate the transaction.

7. Use of Funds

Campaign organizers agree that donated funds must be used only for the legitimate purposes described in the campaign.

Organizers are responsible for:

  • Providing truthful and accurate information.
  • Maintaining appropriate records and supporting documentation.
  • Using funds responsibly.
  • Informing donors of significant changes to the campaign.
  • Complying with applicable tax, reporting, and regulatory obligations.
  • Returning funds when required by law or directed by an authorized payment provider.

Suspected misuse of funds may result in campaign suspension, removal, restriction of transactions, withholding of available funds, reporting to payment providers, or referral to the appropriate authorities.

Although RGS Foundation applies review and security measures, no fundraising platform can provide an absolute guarantee regarding how funds will ultimately be used.

8. Campaign Review and Verification

RGS Foundation may review campaigns before or after publication.

We may request:

  • Personal identification.
  • Proof of identity or authority.
  • Beneficiary consent.
  • Medical, financial, or supporting documentation.
  • Information about the intended use of funds.
  • Updates regarding campaign progress.
  • Additional information necessary for security or compliance purposes.

Publication of a campaign does not constitute an endorsement, certification, or guarantee by RGS Foundation.

9. Campaign Approval, Suspension, and Removal

RGS Foundation reserves the right to approve, reject, suspend, restrict, investigate, or remove any campaign when reasonably necessary.

We may take action when a campaign:

  • Contains inaccurate, incomplete, or misleading information.
  • Violates these terms or another platform policy.
  • Presents suspected fraud, abuse, or security concerns.
  • Infringes intellectual property, privacy, or other legal rights.
  • Promotes unlawful or prohibited activities.
  • Creates an unacceptable risk to donors, beneficiaries, or the platform.
  • Fails to provide requested verification documents.

Transactions or access to funds may be temporarily restricted while an investigation or verification process is conducted.

10. Prohibited Activities

Users may not use the RGS Foundation platform to:

  • Create fraudulent, deceptive, or misleading campaigns.
  • Raise funds for illegal activities.
  • Misrepresent an organizer, beneficiary, organization, or cause.
  • Use donations for purposes materially different from those described.
  • Submit false documents or identification information.
  • Engage in money laundering, terrorist financing, or other financial crime.
  • Harass, threaten, exploit, or abuse another person.
  • Publish discriminatory, hateful, violent, or harmful content.
  • Infringe copyright, trademark, privacy, publicity, or other rights.
  • Introduce viruses, malicious code, or harmful technology.
  • Manipulate donations, campaign statistics, reviews, or platform activity.
  • Attempt to bypass security, verification, payment, or fraud-prevention systems.
  • Collect user information without authorization.
  • Use the platform in any way that violates applicable law.

11. Platform Responsibility

RGS Foundation provides technology and administrative services that facilitate fundraising and donations.

Unless expressly stated otherwise, RGS Foundation:

  • Does not endorse any specific organizer, beneficiary, campaign, or cause.
  • Does not guarantee that a campaign will reach its fundraising goal.
  • Does not guarantee a specific medical, financial, humanitarian, or personal outcome.
  • Is not the organizer or beneficiary of independently submitted campaigns.
  • Is not responsible for decisions made solely on the basis of campaign content.
  • Does not provide medical, legal, tax, or financial advice.

The platform is provided on an “as available” basis, subject to applicable law.

12. Fees and Transactions

Payment-processing, banking, currency-conversion, administrative, or platform fees may apply to donations and withdrawals.

Where applicable, relevant fees will be disclosed during the transaction process or in the campaign documentation.

Payments may be processed by independent third-party payment providers. Their terms, security procedures, refund rules, and privacy policies may also apply.

RGS Foundation is not responsible for delays or failures caused by banks, card issuers, payment processors, or other third-party providers beyond our reasonable control.

13. Taxes and Regulatory Obligations

Donors, organizers, and beneficiaries are responsible for determining whether donations, funds received, fees, or campaign activity create tax, reporting, licensing, or regulatory obligations.

RGS Foundation does not provide tax or legal advice and does not guarantee that a donation will qualify for a tax deduction.

Users should consult a qualified professional regarding their individual obligations.

14. User Responsibilities

Users agree to:

  • Provide accurate, complete, and current information.
  • Keep account credentials secure.
  • Notify us promptly of unauthorized access or suspicious activity.
  • Comply with applicable laws and platform policies.
  • Respect the dignity, privacy, and rights of beneficiaries.
  • Avoid publishing unnecessary sensitive personal information.
  • Cooperate with reasonable verification and security requests.
  • Use the platform honestly and responsibly.

Users are responsible for activity conducted through their accounts.

15. Content Submitted by Users

Campaign organizers retain responsibility for the content they submit, including text, photographs, videos, documents, and updates.

By submitting content, the user confirms that:

  • They own the content or have permission to use it.
  • Publication does not violate another person’s rights.
  • They have obtained appropriate consent from any identifiable beneficiary.
  • The content is accurate and not misleading.
  • Sensitive information is disclosed only when necessary and authorized.

By publishing content on the platform, users grant RGS Foundation a non-exclusive, worldwide, royalty-free license to host, display, reproduce, adapt, distribute, and promote that content for campaign administration, fundraising, verification, security, and communication purposes.

16. Intellectual Property

The RGS Foundation name, logo, branding, website design, software, text, graphics, and original platform materials are owned by or licensed to RGS Foundation.

These materials may not be copied, reproduced, modified, distributed, published, sold, licensed, or commercially exploited without prior written authorization.

Permission to use the platform does not transfer ownership of any intellectual property rights.

17. Privacy and Data Protection

Personal information collected through the platform will be handled in accordance with our Privacy Policy and applicable data-protection laws.

Users who submit information about another person, including a beneficiary, confirm that they have the necessary authority or consent to do so.

18. Third-Party Services and Links

The platform may contain links to or rely on services operated by third parties, including payment processors, hosting providers, analytics services, verification providers, and social media platforms.

RGS Foundation does not control these independent services and is not responsible for their content, availability, security, policies, or actions.

Users should review the terms and privacy policies of relevant third-party providers.

19. Suspension and Termination

RGS Foundation may suspend or terminate access to the platform when a user:

  • Violates these terms or another policy.
  • Submits false or misleading information.
  • Engages in fraudulent, abusive, or unlawful conduct.
  • Creates a risk to donors, beneficiaries, other users, or the platform.
  • Refuses to complete a required verification process.

Termination does not remove obligations or liabilities that arose before access was suspended or terminated.

20. Limitation of Liability

To the fullest extent permitted by applicable law, RGS Foundation and its directors, officers, employees, volunteers, contractors, and partners will not be liable for:

  • The failure of a campaign to reach its goal.
  • The misuse or mismanagement of funds by organizers or beneficiaries.
  • Inaccurate or misleading information submitted by users.
  • Decisions made based on campaign content.
  • Indirect, incidental, special, punitive, or consequential damages.
  • Technical interruptions, data loss, or service unavailability.
  • Acts or failures of banks, payment processors, or other third parties.
  • Unauthorized access or security incidents beyond our reasonable control.

Nothing in these terms excludes or limits liability that cannot legally be excluded.

21. Indemnification

To the extent permitted by law, users agree to indemnify and hold harmless RGS Foundation, its directors, officers, employees, volunteers, contractors, and partners from claims, losses, liabilities, damages, expenses, and legal costs arising from:

  • Their use or misuse of the platform.
  • Their fundraising activities.
  • Content they submit.
  • Misuse of donations.
  • Violation of these terms.
  • Violation of applicable law.
  • Infringement of another person’s rights.

22. Changes to These Terms

RGS Foundation may update these Terms of Service to reflect changes in our services, policies, technology, or legal obligations.

The revised version will be published on this page with an updated effective date.

Continued use of the platform after updated terms become effective constitutes acceptance of those changes, to the extent permitted by law.

23. Governing Law

These Terms of Service will be governed by the laws of the jurisdiction in which RGS Foundation is legally established, unless applicable consumer law requires otherwise.
